Terms and Conditions

The contract between us

These terms and conditions apply to the use of and orders placed on this website. By placing an order with Borba Margo you will be deemed to have read, understood and agreed to these terms and conditions.

Borba Margo reserves the right to withdraw from any contract in the occurrence of any obvious errors or inaccuracies relating to the goods appearing on our website. If an inaccuracy is discovered with regards to the price of the goods in your order, we will be contacting you by e-mail to inform you of the correct price. You will be asked if you wish to continue with the order at the amended price, or if you wish to cancel the order in total. If we cannot contact you or receive no response to our email, we will continue to process the remaining items on your order.

We may refuse your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is therefore withdrawn.

Every care has been taken to ensure that descriptions, measurements and colours are correct. Please note that there may be some variation in the colour of goods shown on the website due to the limitations of photographic and web processes and we cannot be held responsible for any variations in colour that may arise caused by your browser or computer software.

 

Payment

For our payments we use Paypal, you can use your Paypal account of pay directly using your credit card.

We must receive payment of the whole of the price for the products that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form, which will include your name, the order number and the total price.

The credit/debit card that is being used must be yours. All cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery of your order.

 

Price

Goods on this website are priced in GBP and include VAT at 15%. You will be required to pay our charges for delivery.

We reserve the right to amend the prices at any time but the products will be invoiced on the tariff in force at the time of the recording of the order, subject to availability.

Delivery

The products are delivered to the address of delivery, which you have indicated during the process of order. All the sendings will be done via UK Post Office International Signed For. Items will be tracked up to the point they leave the UK (and in some cases on arrival in the destination country). When your order reaches its destination country it is handed over to the local postal service for delivery through their regular registered service. A signature will be taken at the delivery address, please note this will not necessarily be the addressee. If no one is available to sign for the item, then it will be retained by the postal administration for a following delivery attempt or collection by the addressee.
 
Delivery Times

Orders will be dispatched within 5 working days subject to credit clearance, address verification and availability of items.

Please note that during holidays (i.e. Christmas) and exceptionally busy periods (end of Feb/ beginning of March and end of Aug/ beginning of Oct) please allow longer times for despatch. We will contact you if there is a delay or items are out of stock.

For goods delivered outside of the EU, the consignee (i.e. the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and completion.

Delivery times are estimates and shall be used as a guide only and commence from the date of dispatch.

Borba Margo shall not be deemed responsible for any delays caused by destination customs clearance processes.
 
Custom charges

Please also note that any duty and taxes incurred in the country of destination are the responsibility of the customer.

It is recommended that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.
 
Availability

All items are offered subject to availability at time of ordering. It is your responsibility to check at the time of the order, that the quantity, colour, size, and the price of every article in your purchase order is correct.

If any item in your order is out of stock, we will notify you as soon as possible and any sum debited by borbamargo.com from your credit card will be re-credited to your account and you will receive an email notifying you about this at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Borba Margo will not be obliged to present any additional compensation for disappointment suffered.

Borba Margo will have no liability to you for any failure to deliver goods you have ordered or any delay in doing so, for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, industrial disputes, breakdown of systems, failures or sub-contactor transport, network access or accident.
 
Privacy

We will NEVER sell or pass on any of your personal details, including email addresses. We have the greatest respect for your personal privacy, and we will take all reasonable care to not compromise this but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the site.
 
Returns

Products may not be returned nor exchanged.
 
General

We may change or modify these terms and conditions at any time, and your continued use of this site following such change shall signify your agreement to be bound by the modified terms of conditions. Please read the terms and conditions and check back often.
